DMCA Notice & Takedown Policy

Cinelity respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512), Cinelity will respond to claims of copyright infringement on the platform.

1. Designated DMCA Agent

Send copyright infringement notices to our Designated Agent:

The agent above is registered with the U.S. Copyright Office under the DMCA Agent Directory.

2. Filing a Notice of Claimed Infringement

To submit a DMCA takedown notice, send a written notice to our Designated Agent that includes ALL of the following:

  • A physical or electronic signature of a person authorised to act on behalf of the copyright owner.
  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the material claimed to be infringing — please include the URL or specific location on Cinelity.
  • Your contact information (name, address, phone, email).
  • A statement that you have a good-faith belief that use of the material is not authorised by the owner, agent, or law.
  • A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorised to act on behalf of the copyright owner.

Notices that don't include all of the above may not be actionable.

3. Counter-Notification

If you believe content was removed in error, you may submit a counter-notification to our Designated Agent including:

  • Your physical or electronic signature.
  • Identification of the material that was removed and the location where it appeared before removal.
  • A statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification.
  • Your name, address, phone, email, and consent to the jurisdiction of the Federal District Court for the judicial district where you reside (or for foreign residents, any judicial district where Cinelity is located).

4. Repeat Infringers

Cinelity will terminate accounts of users who are determined to be repeat infringers, in appropriate circumstances.

5. False Claims

Filing a false DMCA notice may subject you to liability for damages, including costs and attorney's fees. Don't use this process to take down material you don't own copyright in.
